Activision is Suing Warzone Indie Game
Activision and the indie game developer Randy Ficker still does not negotiate. Thus, the debate among both sides keeps growing.
Randy Ficker claims that Activision sues him
Let’s go one year back and remember what happened. First, Activision came up with a trademark request due to their popular battle-royale game Call of Duty: Warzone. However, an indie developer behind a browser-based strategy game that’s also called Warzone sent a cease-and-desist to stop them. And now, here we are. Randy Ficker says that he has been sued due to the name of Call of Duty: Warzone.
Eventually, we can say that Both Activision and Randy Ficker are in a competition right now. Because both came up with a complaint about the trademark of the name ”Warzone”. However, here is something important: The original browser game Warzone came out back in 2017. Three years earlier than the battle-royale game Call of Duty: Warzone.
And as of now, Randy Ficker came up with a GoFundMe page asking for donations. He claims that he does this to fight Activision in court. He says that he needs money in order to pay the expenses and his game Warzone is the only income.
The explanation of Randy Ficker
Hello, my name is Randy, and I’m being sued by Activision for being an indie game developer,” he says. “In 2017, I launched my indie game Warzone. In 2020, Activision launched ‘Call of Duty: Warzone’ and is now suing me to steal the name. “The law is clear: If you use a name in commerce before someone else, they can’t sue you to get rights for that name. ” “100% of the funds raised in this GoFundMe will be directly used in the legal fight against Activision,”
Activision came up with an answer to this situation. ”The defendant named in this suit has baselessly threatened the company. We do not infringe his intellectual property. We are filing this action so the court can reject his frivolous and irresponsible claims.” says Activision Blizzard spokesperson to Polygon. The situation gets more interesting day by day. We will see what will happen in the future.
